In December 2021, the Working for Workers Act received Royal Assent and amended Ontario’s Employment Standards Act, 2000 (the “ESA”) in a few key manners. One of the ways in which the ESA is changing relates to the introduction of a new licensing regime for temporary help agencies and recruiters. This new licensing requirement is being rolled out in two phases, with the first having occurred on July 1, 2023 and the second coming into effect on January 1, 2024. This is a critical change for temporary help agencies and companies who use such agencies, as such agencies need to start getting their licensing requirements underway now to ensure compliance by January 1, 2024.
